1. Acceptance of Terms

By accessing or using The UpScale Tech website or services, you agree to these Terms of Service. If you do not agree to these Terms, you should not use our website or services.

2. Services

The UpScale Tech provides custom printing, signage, branding, and related services. Most products are custom-made and produced according to customer-provided specifications.

3. Order Process

  • Customers submit an order request through the website or other approved channels.
  • A specialist reviews the request for accuracy, feasibility, and pricing.
  • An invoice is issued once the order is approved.
  • Production begins only after full payment is received.
  • The UpScale Tech reserves the right to refuse or cancel any order.

4. Pricing & Payment

  • Prices are subject to change until an invoice is issued.
  • Payment must be made in full before production begins.
  • Failure to submit payment may result in order cancellation.

5. Customer Responsibilities

Customers are responsible for:

  • Accuracy of submitted content, artwork, and files
  • Confirming spelling, dimensions, colors, and layout
  • Carefully reviewing and approving final proofs

The UpScale Tech is not responsible for errors that have been approved by the customer.

6. Proofs & Revisions

  • Proofs may be provided when applicable.
  • Revisions may be limited depending on the project.
  • Additional revisions may incur additional charges.
  • Final approval confirms acceptance of the design and specifications.

7. No Returns or Refunds

Because all products are custom-made:

  • All sales are final.
  • No refunds or returns are accepted unless the error is directly caused by The UpScale Tech.
  • Claims must be submitted within 48 hours of delivery and include photographic evidence.

8. Intellectual Property

  • Customers confirm they own or have legal rights to all submitted designs and materials.
  • The UpScale Tech is not responsible for copyright or trademark violations.
  • The UpScale Tech may display completed projects for portfolio or marketing purposes unless prohibited in writing by the customer.

9. Production & Delivery

Production timelines are estimates and are not guaranteed. The UpScale Tech is not responsible for delays caused by shipping carriers, suppliers, or events beyond our control, including force majeure.

10. Limitation of Liability

To the fullest extent permitted by New Jersey law, The UpScale Tech shall not be liable for any indirect, incidental, or consequential damages.

The maximum liability shall not exceed the amount paid for the specific order.

11. Termination of Service

The UpScale Tech reserves the right to refuse service, cancel orders, or terminate access for violations of these Terms.

12. Governing Law & Venue

These Terms shall be governed by and interpreted in accordance with the laws of the State of New Jersey, without regard to conflict-of-law principles. Any disputes shall be resolved in the courts located in New Jersey.

13. Changes to Terms

We may update these Terms at any time. Continued use of our services constitutes acceptance of the updated Terms.
